6.1 Guest Information
At the time of booking, the client must provide accurate and complete details for all guests, including full names, ages, and any relevant medical or dietary information if applicable. This information is required for compliance with maritime safety regulations and to ensure a seamless embarkation process.
6.2 Compliance and Conduct
Throughout the charter, the client and all guests must adhere to all applicable safety regulations, maritime laws, customs, and the captain’s instructions. In addition, the client agrees to comply with all terms, policies, and operational requirements outlined in the signed Charter Agreement, which forms the governing contract for the voyage.
6.3 Liability for Damages
The client shall be financially liable for any damage, loss, or excessive wear caused to the yacht, its furnishings, or equipment through negligence, misuse, or misconduct by the client or their guests. Any such damages may be deducted from the Advanced Provisioning Allowance (APA) or billed separately.
6.4 Passenger Conduct and Safety
The client assumes full responsibility for the behaviour, conduct, and safety of all guests onboard throughout the charter period. All passengers must comply with safety briefings and operational instructions provided by the crew at embarkation and during the voyage.
6.5 Captain’s Authority
The client acknowledges that the captain retains ultimate authority over the yacht, including all matters related to navigation, safety, and itinerary adjustments. The captain’s decisions are final and binding, and may include changes to the route or schedule based on weather conditions, safety concerns, or port restrictions.
6.6 Special Terms and Provisions
Any special requests, custom arrangements, or specific terms—including but not limited to pet policies, smoking permissions, event hosting, or extended cruising routes—shall be governed by the provisions outlined in the signed Charter Agreement. In the event of any discrepancy between these Terms & Conditions and the Charter Agreement, the Charter Agreement shall prevail.
